These Terms of Use & Sale (“Terms”) are an agreement between DealDoctor PLLC (“DealDoctor,” “we,” “us,” or “our”) and you. They govern your use of the website dealdoctor.pro, including the CARMAcademy™ store (together, the “Site”), and your purchase of digital products through the Site. By using the Site, subscribing to our emails, booking a call, or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. Educational Content — Not Legal Advice
Everything on this Site — including pages, emails, free resources, manuals, programs, and other digital products — is educational and informational content only. It is not legal advice and is not a substitute for advice from a licensed attorney about your specific situation. Reading this Site, subscribing to our emails, downloading resources, booking an introductory call, or purchasing products does not create an attorney-client relationship with DealDoctor PLLC or any of its attorneys. An attorney-client relationship is formed only by a signed engagement agreement.
2. Purchases and Payment
Products sold on the Site are digital products delivered electronically (typically as downloads or emailed links). Prices are stated in U.S. dollars and may change at any time before purchase. Payment is processed at checkout by third-party payment processors; we do not receive or store full payment card numbers. You agree to provide accurate billing information and are responsible for any applicable taxes.
3. Digital Product License
Our manuals, guides, templates, and other digital products (the “Materials”) are the copyrighted intellectual property of DealDoctor PLLC. All rights reserved. Your purchase is a license, not a transfer of ownership.
When you purchase Materials, you receive a limited, non-exclusive, non-transferable license, granted to the purchasing individual or entity, to use the Materials for personal use and internal business use within the purchasing individual’s or entity’s own organization only.
You may not, without the prior written permission of DealDoctor PLLC:
- Share, redistribute, resell, sublicense, rent, or give away the Materials, in whole or in part
- Post the Materials (or substantial excerpts) publicly, including on websites, file-sharing services, or social media
- Use the Materials to teach, train, or build courses, workshops, or programs (paid or unpaid) for third parties
- Create derivative works from the Materials for use or distribution outside your own organization
- Remove or alter copyright, trademark, or attribution notices
Any use outside this license infringes DealDoctor PLLC’s copyright and may result in termination of your license and legal action. To request permission for other uses (for example, team licenses or teaching), contact DealDoctor@DealDoctor.Pro.
4. Refund Policy for Digital Downloads
The Materials are digital intellectual property delivered electronically and immediately. Because of the nature of digital products, all sales are final once the product has been downloaded or accessed, except where a refund is required by applicable law.
If you experience a problem with your purchase — such as a failed download, a duplicate order, or a defective file — contact us at DealDoctor@DealDoctor.Pro and we will make it right. Purchase problems are reviewed and resolved on a case-by-case basis.
5. Intellectual Property and Trademarks
The Site and all content on it are owned by DealDoctor PLLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws. CARMA™, CARMAI™, CARMAcademy™, DealDoctor®, INTEGRIS™, AAA Standard™, Quad C Mindset™, 5Cs of Contracts™, BusinessWell™, and Legality vs Reality™ are trademarks of DealDoctor PLLC. No license to use any trademark is granted by these Terms or by any purchase.
6. CARMAI™ Software
The CARMAI™ software platform is a separate product and is governed by the CARMAI™ End User License Agreement at carmai.app/eula and the CARMAI™ Privacy Policy at carmai.app/privacy. Nothing in these Terms modifies the CARMAI™ EULA. These Terms govern this Site and digital-product purchases only.
7. Acceptable Use of the Site
You agree not to misuse the Site, including by attempting unauthorized access, interfering with its operation, scraping or systematically downloading content, framing or mirroring the Site, or using the Site for any unlawful purpose. We may suspend or terminate access for violations of these Terms.
8. Email Communications
By opting in to our email list, you consent to receive marketing and educational emails from DealDoctor PLLC. You can unsubscribe at any time using the link included in every marketing email. Transactional emails (such as receipts and download links) are sent as part of your purchase. See our Privacy Policy for details.
9. Disclaimers
THE SITE AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE MATERIALS WILL MEET YOUR REQUIREMENTS OR THAT ANY PARTICULAR BUSINESS OR LEGAL OUTCOME WILL RESULT FROM THEIR USE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEALDOCTOR PLLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE OR THE MATERIALS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE OR THE MATERIALS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM (OR $100 IF NO PURCHASE WAS MADE). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless DealDoctor PLLC and its members, officers, and employees from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, including any unauthorized distribution of the Materials.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
If a dispute arises out of or relates to these Terms, the Site, or the Materials, the parties will first attempt to resolve it through good-faith negotiation for thirty (30) days following written notice of the dispute. Any dispute not resolved through negotiation will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, with the arbitration conducted in New York, New York. The arbitrator’s decision will be final and binding on the parties.
13. Changes to These Terms
We may update these Terms from time to time. The version posted on this page at the time of your purchase governs that purchase. Continued use of the Site after updated Terms are posted constitutes acceptance of the changes.
